DUI law is very complicated, and can be difficult for the average person to navigate. A good attorney will make sure that you meet all of your deadlines and help you with the court systems.
The first thing you will need to worry about after a DUI arrest is losing your driving privileges. Did you know that in Georgia your driver's license can be suspended even before you are charged with driving under the influence?
There are two ways that you can lose your license before going to criminal court. The first is refusing to take a chemical test. This is due to "implied consent." When you got your driver's license, you agreed that you would submit a blood, breath, or urine test if a law enforcement agent believed that you were under the influence of drugs or alcohol. If the officer read the Georgia Implied Consent Warning to you, and you refused, your license can be suspended for up to one year.
The other way to lose your license is to fail your chemical test with a blood alcohol content (BAC) of 0.08 percent or higher. If you are under the age of 21, you will lose your license with a BAC of 0.02 percent or higher.
After your refusal or test failure, the officer will contact the Department of Public Safety to initiate an administrative license hearing. This hearing is conducted by the Office of State Administrative Hearings. After your arrest, you have ten days to request an administrative hearing. If you do not request a hearing within this time, your license will be suspended. The length of the suspension depends on how many prior offenses you have had.
